致 ICTI“關愛”程序(ICP)認證工廠(chang):?
每年許多工廠都會在暑假期間聘用學生工以應對生產高峰期及解決勞動力不足的問題。在過往的工廠審核中我們也發現由于個別工廠管理體系失效未嚴格審查學生工的年齡,導致審核中發現有童工冒用他人身份證件甚至使用偽造身份證件在工廠工作的情形。由于使用童工違反了 ICP 的零度容忍政策,這些工廠的 ICP 證書已被立即終止。?

鑒于此,ICTI“關愛”程序提醒各工廠:在暑假期間會出現大量省內外在校學生(其中可能不乏未滿 16 周歲的少數民族或東南亞國籍的童工)以“實習”、“勤工儉學”為名來到各工廠短期務工的情況,各工廠應謹慎招聘暑假期間的學生工,嚴格審查未能出示身份證原件、提供虛假身份證、身份證照片與本人明顯不符,或身體特征疑似童工的學生工,防止不慎聘用未滿 16 周歲的童工。?

再次重(zhong)申(shen)(shen)(shen) ICTI“關愛(ai)”程序有關童(tong)工(gong)(gong)(gong)(gong)(gong)的(de)零度容忍政策:若在(zai)審核(he)中發(fa)現工(gong)(gong)(gong)(gong)(gong)廠(chang)(chang)聘用(yong)了(le) 2 名(ming)或2 名(ming)以上的(de)童(tong)工(gong)(gong)(gong)(gong)(gong)、或明知(zhi)其年齡不足仍故(gu)意聘用(yong)童(tong)工(gong)(gong)(gong)(gong)(gong)的(de)情況,工(gong)(gong)(gong)(gong)(gong)廠(chang)(chang)的(de) ICTI 證(zheng)(zheng)(zheng)書將被(bei)立即終(zhong)止。自終(zhong)止決議(yi)之日起(qi),工(gong)(gong)(gong)(gong)(gong)廠(chang)(chang)須等待 6 個月才能重(zhong)新申(shen)(shen)(shen)請 ICP 認證(zheng)(zheng)(zheng)。若工(gong)(gong)(gong)(gong)(gong)廠(chang)(chang)未能及時解(jie)救(jiu)童(tong)工(gong)(gong)(gong)(gong)(gong)并提交相(xiang)關證(zheng)(zheng)(zheng)據,或發(fa)現工(gong)(gong)(gong)(gong)(gong)廠(chang)(chang)提供的(de)解(jie)救(jiu)童(tong)工(gong)(gong)(gong)(gong)(gong)證(zheng)(zheng)(zheng)據系偽造,工(gong)(gong)(gong)(gong)(gong)廠(chang)(chang)的(de) ICP 證(zheng)(zheng)(zheng)書將被(bei)立即終(zhong)止且此后的(de)重(zhong)新申(shen)(shen)(shen)請將被(bei)永(yong)久拒(ju)絕。?

此外(wai),ICTI“關愛”程(cheng)序對暑期學生工(gong)有以下特(te)別要(yao)求,望工(gong)廠知悉及符合(he):?
1. 若暑期工(gong)年(nian)(nian)滿 16 周(zhou)(zhou)歲但未(wei)(wei)滿 18 周(zhou)(zhou)歲,工(gong)廠(chang)必須依據未(wei)(wei)成(cheng)年(nian)(nian)工(gong)保(bao)護的相關法律法規,如:只安排未(wei)(wei)成(cheng)年(nian)(nian)工(gong)在無(wu)毒無(wu)害工(gong)作(zuo)崗位,工(gong)廠(chang)出資為(wei)其安排未(wei)(wei)成(cheng)年(nian)(nian)工(gong)健康體檢(jian)等。?
2. 暑期工(gong)工(gong)資標準必(bi)須不低(di)于工(gong)廠所在(zai)地最低(di)工(gong)資標準;?
3. 工(gong)廠必(bi)須保留暑期工(gong)的人事記(ji)錄(入職(zhi)檔案、身份證、年齡證明等(deng))、考勤(qin)記(ji)錄及工(gong)資支(zhi)付記(ji)錄;?
4. 工廠必須將(jiang)工資直接支付給暑期工本人;?
5. 勞務中(zhong)介(jie)費用(yong)或(huo)學(xue)校老(lao)師代表的生(sheng)活費用(yong)必須由工廠支付,而不應轉嫁給(gei)暑期工;?
6. 在工(gong)(gong)(gong)廠招錄暑(shu)期(qi)工(gong)(gong)(gong)的合同期(qi)間,工(gong)(gong)(gong)廠務必確保勞(lao)務中介或學校老(lao)師代(dai)表不可向(xiang)暑(shu)期(qi)工(gong)(gong)(gong)收取任何費(fei)用(yong)(包括報名費(fei)、學費(fei)、交(jiao)通(tong)費(fei)等(deng))以(yi)及扣押暑(shu)期(qi)工(gong)(gong)(gong)的任何有效證件(包括身份證、學生證、畢業證等(deng));?
